Perera Barnhart has experience in virtually all labor and employment areas of law. Although the Firm has extensive experience in litigation, the Firm understands that, sometimes, the avoiding of litigation yields the best results for our clients. This is particularly true with respect to our institutional clients. As a Firm, we serve as General Counsel for several employers.

In handling cases in litigation, the Firm often identifies policies or strategies that could have prevented the issues being litigated.  The Firm encourages employers to employ resources, energy and effort on preventive labor and employment measures.  Litigation is costly and disruptive.  So is a problematic work environment.

Following complex legal procedures takes valuable time away from management’s real job — running and promoting business. As a Firm, we regularly:

  • counsel employers on day-to-day issues;
  • analyze whether workers are properly classified as independent contractors or employees;
  • analyze whether workers are properly classified as exempt from the FLSA’s overtime requirements;
  • draft handbooks and policies;
  • draft employment agreements (when appropriate);
  • draft non-compete, non-solicitation, and confidentiality agreements;
  • devise plans and strategies to prevent claim of unpaid wages;
  • provide internal audits to identify areas of exposure;
  • train workers on how to prevent issues in the workplace;
  • provide advice on employee discipline and discharges;
  • provide advice on traditional labor/union issues; and
  • provide all other labor and employment work needed by our institutional clients.
